At Casa de Pilates (“company”, “we”, “us”, “our”), we respect your privacy and want to protect your personal information.  In this Privacy Policy, Company shall mean collectively Casa de Pilates LLC and its affiliates, any related individuals, and subsidiaries, and any of their trustees, directors, officers, shareholders, members, employees, representatives, consultants, attorneys, agents, suppliers, distributors, licensees and/or licensors (“affiliates”). 

We collect, use, secure and disclose information about you when you access or use our website located at https://www.casadepilates.com/ (the “Website”), when you visit us at our studio (“Studio”), and when you interact with us through any other websites, pages, features, or content owned and operated by us that direct to this Privacy Policy (collectively, the “Services”).

We follow this privacy policy in accordance with the applicable law of the United States.

  1. Information We Collect

Our Website collects information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). 

We may collect the personal information and sensitive personal information categories listed in the table below.  We do not knowingly collect sensitive personal information of children under 16 years of age, nor do we sell or share children’s’ personal information with third parties for cross-context behavioral advertising.

Such as your payment information, billing address, and the products and services purchased.

We use this information only to complete your transactions, process your waivers, and fulfill other requests.

We may share some of this information with our service providers to effectuate your payment transactions.

Such as through our security cameras and CCTV systems.

To support our own internal business purposes, such as for data analysis, audits, security and fraud monitoring and prevention, developing new products and services, and improving your experience at our Studio and on our Services.

This information is shared only with our service providers who help us ensure you are safe when you visit our Studio.

We do not collect any sensitive personal data as defined by the applicable laws and we do not draw inferences from your personal information to build your consumer profile.

Our Services obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete, like waivers or class subscriptions, or products and services you purchase.

  • Indirectly from you. For example, from observing your actions on our Website. This information is collectively referred to herein as “Usage Information.”  If you no longer wish for us and/or our service providers to collect and use location information, you may disable the location features on your device. You may consult your device manufacturer settings for instructions. Please note that if you disable such features, your ability to access certain features, Services, content, promotions, and/or products may be limited or disabled. We may collect your Internet Protocol address, browsing history, device type, and IP addresses, referring and exit web pages and URLs, and certain other device data, including the time of day you visit our Website.

2. Use of Cookies and other Tracking Technologies

We may also use various methods and technologies to store or collect Usage Information (“Tracking Technologies”). Tracking Technologies may set, change, alter and/or modify settings or configurations on your device.   • Web Beacons. A web beacon is a small tag (which may be invisible to you) that may be placed on our Website’s pages and messages.

  • Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Website, such as the links you click on. 

  • ETag, or entity tag. An ETag or entity tag is a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. 

  • Browser Fingerprinting. Collection and analysis of information from your device, such as, without limitation, your operating system, plug-ins, system fonts and other data, for purposes of identification.

  • Recognition Technologies. Technologies, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user).

We may use the personal information we collect for one or more of the following purposes: 

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns. 

  • To provide, support, personalize, and develop our Services.

  • To create, maintain, customize, and secure your account with us.

  • To process your requests, purchases, transactions, and payments and prevent transactional fraud.

  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.

  • To personalize your Website experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our Website, third-party websites, and via email or text message (with your consent, where required by law).

  • To help maintain the safety, security, and integrity of our Website, products and services, databases and other technology assets, and business.

Within Our Corporate Organization. With affiliated businesses within our corporate organization, or companies within our corporate family and our current and future parents, affiliates, subsidiaries, franchisees, and/or other companies under common control and ownership to help maintain and improve our Services and other offerings.

With Business Partners.  With business partners and other third parties, such as promotional partners with whom we partner to offer contests or other joint-promotional activities.

With Service Providers.  With service providers, who may have access to or need to process your personal information in order to provide us with services. These services may include, among other things, to help us fulfill your requests, to create or maintain our databases, to research and analyze the people who request products, services, or information from us, to prepare and distribute communications, to respond to inquiries, website hosting, customer relationship management, to deliver advertising-related services, analytics and market research, to process payments,  process authentication and log-in information, backup, storage, payment processing, analytics and other services. These third-party service providers may have access to or process your personal information for the purpose of providing these services for us. 

Analytics: We may collect, and we may engage third-party analytics providers to collect, metrics and information regarding your use of the Services, including evaluating how visitors use our Website to develop new features, improve existing features or inform sales and marketing strategies. When we process these data, any personal information is anonymized. 

Advertising and Marketing Partners: We may use third-party advertising partners like Google Analytics, and other similar services to serve advertisements on our Services and on selected websites and mobile applications operated by others. These companies may set their own cookies or use similar web technologies to collect information about your online and mobile device activities over time and across different websites. These companies then may direct advertisements to you based on your interests as suggested by the history of your visits to our Services. 

Legal or Regulatory Purposes: We share information with governmental and regulatory entities as necessary to fulfill our legal obligations. 

We may disclose your personal information to third parties in limited circumstances such as (i) to comply with our legal and regulatory obligations, (ii) to make or defend legal claims, (iii) to protect against the fraudulent activity of the account holder and/or others, (iv) to enforce our Terms of Service and this Privacy Policy, (v) for internal operations (including, but not limited to, research, statistics, review of our company’s practices under the authorization of a state or national licensing board, or as necessary to properly respond to an inquiry or complaint from such a licensing board or  organization); and (vi) to disclose as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to protect our operations or those of any of our affiliated parties; (c) to protect our rights, privacy, safety or property, and/or that of our affiliated parties, users  or others; and/or (d) to allow us to pursue available remedies or limit the damages that we may sustain; (iv) in conjunction with a prospective purchase, sale, or merger of all or part of our company, provided that we take appropriate precautions (for example, through a written confidentiality agreement) so the prospective purchaser or merger partner does not disclose information obtained in the course of the transaction. 

We may aggregate, de-identify, and/or anonymize any information collected through the Services to the extent that such information is no longer linked to your personally identifiable information. We may use and share this aggregated and anonymized information (non-personal information) for any purpose, including without limitation, for research and marketing purposes, and may also share such data with our affiliates and third parties.

5. Retention

We will retain your personal information for as long as needed to provide you Services and as necessary to comply with our legal obligations, resolve disputes and/or enforce our agreements. If you wish to delete your personal information, you may contact us by submitting a request as described in “Your Rights and Choices” section of this Privacy Policy.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. 

When you delete data, we follow a deletion policy to make sure that your data is safely and completely removed from our servers or retained only in anonymized form. However, please note even after you have closed your account or have stopped using our Services, we may continue to store your personal data if doing so is necessary for us to fulfill our legal obligations.  We may be required to keep your information for as long as necessary (i) to comply with our legal and regulatory obligations, (ii) to make or defend legal claims, (iii) to protect against the fraudulent activity of any account holder and/or others, (iv) to enforce our Terms of Service and this Privacy Policy, (v) to administer our Services and keep them safe and secure, and for internal operations (including, but not limited to, research, statistics, troubleshooting, data analysis, testing, survey and similar purposes); and (vi) to disclose as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to protect our operations and/or those of any of our affiliated parties; (c) to protect our rights, privacy, safety and/or property, and/or that of our affiliated parties, users or others; and/or (d) to allow us to pursue available remedies or limit the damages that we may sustain.

6. Children’s Privacy

You must be at least 13 years old to use our Website. We do not share personal information of children under 16 for targeted advertising. If we become aware that a child under the age of 13 has provided us with personal information, we will delete the information from our records. However, we may collect personal data of a child under 13 directly from parents or legal guardians in order for them to complete the waiver form available on our Website.

  • Changes To Your Personal Information. We rely on you to ensure that the personal information we maintain about you is accurate. If you believe we have incorrect information about you, please submit a request to correct as described below. 

  • Deletion Of Your Personal Information. You may request that we delete your personal information. If required by law, we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purpose.  You may also request that we remove content or information that you have publicly posted to our Services. If you would like to request removal of content or information, please contact us as described in the “Contact Us” section below.  Please note that the removal of content may not ensure complete or comprehensive removal of that content or information posted through the Services.

  • Opt-out Rights. You may opt-out of online interest-based targeted advertising via the “Your Privacy Rights” link on our homepage. Please note that if you change browsers or computers, or if you clear your browser’s cache, you may need to click the link again to apply your preference.  You have a right to request that we do not sell or share for cross context behavioral advertising your personal information to third parties.  We do not sell your personal information for money, but we use tracking technologies to help us to understand our customers and visitors to the Services, to enhance your online experience, and to customize our offerings in ways that may be deemed a “sale” or “sharing” of personal information under the California Consumer Privacy Act (“CCPA”), as amended by California Privacy Rights Act ("CPRA").  This includes sharing personal information with third parties such as ad networks that collect personal information via tracking technologies to serve personalized advertisements on and off our Services, provide us with data collection, reporting, ad response measurement. To the extent we or our partners use such technologies on the Services, we offer you the ability to discontinue this practice.  To exercise your right to opt-out of such “sales” or “sharing”, please submit a request by visiting the “Your Privacy Rights” link on our homepage or by emailing us as described in the “Contact Us” section below. We do not knowingly sell, share or otherwise disclose the personal information of consumers under the age of 16.

  • Objection to Certain Processing. You may object to our use or disclosure of your personal information by contacting us as described below. 

  • Online Tracking/ Opt-Out Preference Signal. We do not currently recognize the “Do Not Track” signal, but you may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal).   • Right to Limit Use of Sensitive Information. This right is limited to sensitive personal information used for the purpose of inferring characteristics about an individual. We do not collect sensitive personal information nor do we use sensitive personal information for the purpose of inferring characteristics about an individual, therefore we do not offer a path to exercise this right.

  • Right of Non-Discrimination and Non Retaliation. This right prohibits (a) denying an individual access to or use of goods and services, (b) charging different prices or rates for those goods and services, and/or (c) providing a different level or quality of those goods or services, as a result of the individual exercising any right(s) under any data protection and/or privacy laws and/or regulations. We will not discriminate against you because you made any of these requests. We will not: (i) deny you goods or services; (ii) charge you different prices or rates for those goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of our goods or services, or (iv) suggest that you may receive a different price or rate for our goods or services or a different level or quality of our goods or services. However, we may offer you certain financial incentives that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Other marketing communications. You can opt-out of receiving marketing communications from us by going toinfo@casadepilates.com ]and providing the names/email address that you would like removed from our marketing databases and added to our “Do Not Contact” list or by following the unsubscribe instructions included in our marketing communications. 

  • You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive from us.

  • You can stop receiving promotional postal mail at any time by calling (714)333-0475.

  • You can opt-out of receiving text messages from us by replying “STOP” to the text message you receive from us. Please note that this will only opt you out of the specific text messaging program associated with that number.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, to process transactions and facilitate customer requests, and/or to protect against fraud and other misuse of our Services.  We will take reasonable steps to verify your identity prior to responding to certain of your requests. The verification steps will vary depending on the sensitivity of the personal information. 

Your request must:

  • Provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of such person; and

  • Describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.

We cannot respond to your request if we cannot verify your identity or authority to make the request and confirm that the requested personal information relates to you. In order to verify your identity, we will generally require the matching of sufficient information you provide us to the information we maintain about you in our systems. Please provide your name, email address in the original request, as well as an explanation of the right you wish to exercise. We will use the information provided in a request solely to verify your identity or authority to make the request and to review and comply with the request. If you do not provide this information, we may not be able to verify or complete your request in all circumstances. 

Authorized Agent. You may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

9. Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at info@casadepilates.com. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. 

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

10. Personal Information Sales Opt-Out and Opt-In Rights

If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years old, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 15 years old, or the parent or guardian of a consumer less than 13 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by following the same link.

We reserve the right to amend this privacy policy at our discretion and at any time. When we make changes to this privacy policy, we will post the updated notice on the Website and update the notice's effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
